Waiver & Assumption of Risk

1st Klass Enterprise LLC

By booking, participating in, or boarding any vessel, watercraft, vehicle, or experience provided by 1st Klass Enterprise LLC ("Company"), you acknowledge and agree to the following:

1. Assumption of Risk

Participation in boating, water sports, Jet Ski rentals, yacht charters, docking activities, swimming, sandbar visits, and related activities involves inherent risks, including but not limited to:

• Slips, falls, or drowning
• Weather-related hazards
• Collisions or equipment malfunction
• Water conditions and marine life
• Injury caused by other passengers or third parties

2. Release of Liability

To the fullest extent permitted by Florida law, you release, waive, and discharge 1st Klass Enterprise LLC, its owners, officers, captains, employees, contractors, and affiliates from any and all liability for:

• Personal injury
• Property damage
• Loss or theft of personal belongings
• Medical expenses
• Emotional distress
• Wrongful death

This release applies whether caused by negligence or otherwise, except in cases of gross negligence or willful misconduct.

3. Passenger Responsibility

All guests agree to:

• Follow Captain instructions at all times
• Comply with U.S. Coast Guard safety regulations
• Avoid reckless or dangerous behavior
• Refrain from illegal substances
• Drink responsibly

4. Medical Fitness

By participating, you confirm that:

• You are physically able to participate
• You do not have medical conditions that would endanger yourself or others
• You are not under the influence of illegal substances

If you have a medical condition, you participate at your own risk.

5. Indemnification

You agree to indemnify and hold harmless 1st Klass Enterprise LLC from any claims, damages, legal fees, or losses arising from:

• Your actions
• Guest behavior
• Violation of laws or safety instructions
• Damage to equipment caused by misuse

6. Property Damage

Guests are financially responsible for damages caused by negligence, misuse, or intentional acts.

7. Photo & Media Release (Optional)

Unless otherwise requested in writing, you grant 1st Klass Enterprise LLC permission to use photos and videos captured during your experience for marketing and promotional purposes.

8. Binding Agreement

By booking or participating in services, you confirm that:

• You have read and understand this waiver
• You agree voluntarily
• You waive certain legal rights
